None appears for the opposite party. 3. The revisional application has been preferred by the wife/petitioner praying for transfer of Matrimonial Suit no. 246 of 2026 under Section 9 of the Hindu Marriage Act, 1956 from the Court of the learned Additional District Judge, 2nd Court, Suri, Birbhum to the Court of the learned District & Sessions Judge, Jalpaiguri. 4. It is the case of the petitioner/wife that she is residing at S.N. Dutta Sarani, Lake Town, P.O.Bhaktinagar, P.S. New Jalpaiguri, Dist. Jalpaiguri, PIN-743 007. 5. On the other hand the husband/opposite party presently residing at C/o Manju Sinha, near Ariadaha Sanghabaddha Club, Lane-A.C. Banerjee Road, Dist. – North 24 Parganas, Kolkata, PIN-700057. 6. The petitioner/wife now prays that the Matrimonial Suit 246 of 2026 pending before the Court of the learned Additional District Judge, 2nd 2 Court, Suri, Birbhum be transferred to the Court of the learned District & Sessions Judge, Jalpaiguri. 2 7. Considering the said difficulty of the petitioner/wife to travel to Suri on regular basis, this Court relying upon the judgments of the Hon’ble Supreme Court in N.C.V. Aishwarya vs A.S. Saravana Karthik Sha, in Civil Appeal No(s). 4894 of 2022 (arising out of SLP (C) No(s). 16465 of 2021), decided on July 18, 2022, (Para 11, 12), directs that the Matrimonial Suit no. 246 of 2026 be withdrawn from the Court of the learned Additional District Judge, 2nd Court, Suri, Birbhum and be transferred to the Court of learned District & Sessions Judge, Jalpaiguri. 8. The learned District & Sessions Judge, Jalpaiguri, shall proceed with the suit in accordance with law with due notice upon both the parties. 9. Keeping in mind the case of the opposite party herein, the learned District & Sessions Judge, Jalpaiguri, shall be at liberty to permit the opposite party to appear virtually, if such prayer is made. 10. CO 3117 of 2026 stands disposed of. 11. Parties to act on the server copy of this order. 12. Let a copy of this order be sent to the concerned Courts for immediate compliance. (Shampa Dutt (Paul), J.)
