1. Present petition has been filed challenging the
order dated 4th October, 2024 passed by learned Civil Judge (Senior Division), Second Court, Contai, Purba Medinipur in Title Appeal No. 19 of 2018.
2. The appeal was filed against the order passed by learned Civil Judge, Junior Division, Additional First Court, Contai in Title Suit No. 1 of 1993 while the First Appellate Court had rejected
the
application
of
the petitioner/defendant for stay of the execution proceedings.
3. During the course of submissions learned counsel for the opposite party/plaintiff/decree holder submits that present petition may be
disposed of with a direction to the appellate court for expeditious disposal of the appeal.
4. Learned counsel for the opposite party/decree holder submits that till disposal of the appeal the decree holder will not execute the decree till disposal of the appeal.
5. In view of the submissions made the Court of learned Additional District and Sessions Judge, First Court, Contai is directed to dispose of the Title Appeal No. 19 of 2018 expeditiously preferably within six months without giving any unnecessary adjournment.
6. It is also pertinent to mention that this Court has not gone into the merits of the case and no expression made herein shall tantamount to be in expression on the merits of the case.
7. This petition and connected application are
disposed of.
8. In view of the submissions of the learned counsel for the decree holder the operation of the order passed in Title suit No. 01 of 1993 which is impugned in Title Appeal No. 19 of 2018 shall remain stayed till disposal of the appeal. 2
