1. Learned counsel for the petitioner submits that an appropriate direction may be passed for disposal of representation dated 8th January, 2020 in accordance with law expeditiously.
2. Learned counsel submits that in case the representation is decided favourably the Kolkata Municipal Corporation may be directed to take proper action.
3. Learned counsel for the Kolkata Municipal Corporation
undertakes
that
the representation dated 8th January, 2020 shall be considered and decided expeditiously in accordance with law after giving the parties an opportunity of being heard.
4. Learned counsel also indicates that appropriate action shall be taken in accordance with the decision of the representation.
5. In view of the submissions made the present petition is disposed of with a direction to the Kolkata Municipal Corporation to consider and decide the representation dated 8th January, 2020 in accordance with law expeditiously after giving an opportunity of being heard in accordance with law. The Kolkata Municipal Corporation shall thereafter take action in accordance with law.
6. Since affidavit has not been filed by the respondents any averments or allegations made in the writ petition are not deemed to have been admitted.
7. It is also pertinent to mention that this Court has not gone into the merits of the case and no expression made herein shall tantamount to be in expression on the merits of the case.
8. This petition is disposed of.
9. Urgent photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all usual requisite formalities. 2
