Kausik (Allowed) CRM (M) 1854 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Dholahat Police Station Case No. 227/2023 dated 21.08.2023 under sections 302 of the Indian Penal Code. And In the matter of : Buddhiswar Pramanik ……Petitioner. Mr. Mujibar Ali Naskar Mr. Sandip Kr. Mondal Ms. Ritika Yadav ……for the Petitioner. Mr. Kallol Kumar Basu Mr. Shayam Sachin Basu ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody since 23rd May, 2023 for a period of 3 years and 4 months. Till date witness action has not commenced. State opposes the prayer for bail and has emphasized on the statement of the child. I have taken into account the overall materials. Prima facie, it reflects that the present petitioner was suffering from depression. As a consequence of which he strangulated his wife to death and himself consumed poison. Such fact is available from the records of the case. 2 Having taken into account the background of the case as also the fact that petitioner is in custody for more than 3 years and 4 months and there are no antecedents of the present petitioner, I am inclined to release the petitioner on bail. Accordingly prayer for bail of the petitioner is allowed. As such, petitioner, namely Buddhiswar Pramanik be enlarged on bail subject to furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned ACJM, Kakdwip, South 24 Parganas. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of South 24 Parganas without the prior permission of the learned Trial Court. Accordingly, CRM (M) 1854 of 2026 is allowed. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
