Rakib (Rejected) CRM (NDPS) 2013 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Panskura Police Station case no. 606 of 2024 dated 02.08.2024 20(b)(ii)(c) of the NDPS Act. And In the matter of : Azizul Rahaman Mollah @ Ajijul Rahaman Molla & Anr. ……Petitioners. Mr. Amal Krishna Samanta Mr. Subhas Jana ......for the Petitioners. Mr. Anamitra Banerjee Ms. Priyanka Bhattacharya ……for the State. Learned advocate appearing for the petitioners submit that petitioners are in custody for two years one month and there has been no substantial progress in the trial. Learned advocate appearing for the State opposes the prayer for bail and submits that from the joint possession of the petitioners 34.380 kgs of ganja were recovered. The seizure list witnesses being examined in this case and I find that there is corroboration of the prosecution facts in respect of the deposition from the independent seizure list witnesses. Having regard to the period of detention of the petitioners, the learned trial Court is directed to complete the rest of the witnesses in view of the detention of the petitioners within a period of four months. 2 In case, after the aforesaid time period the trial of the case is not completed, petitioners will renew his prayer for bail before this Court. Accordingly, CRM (NDPS) 2013 of 2026 is dismissed at this stage. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
