... Petitioner. Mr. Santanu Talukdar, Mr. Manojit Debnath
... For the Petitioner. Mr. Ramasish Mukherjee, Ms. Pramita Banerjee
... For the State. Learned advocate appearing for the petitioner submits that petitioner is a driver who has been foisted with the criminal case and is languishing in jail since 10.08.2023 for more than three years. Petitioner contends that similarly placed accused persons have been granted bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that so far as the present petitioner is concerned, he is not similarly situated and his role is completely different from other accused persons. To that effect, State has produced the case diary and draws the attention of the Court to the statement of one of the victim girls. 2 From the spirit of the said statement, I find that this petitioner has been described as ‘Kalu’ and his job was in the nature of assigning victims to different customers. Having considered the role of the petitioner is completely different from others, only on the ground of Article 21 of the Constitution of India petitioner as of right cannot claim bail. As such, the prayer for bail of the petitioner is rejected. Learned Trial Court would expedite the process and complete the evidence of relevant vulnerable witnesses preferably within a period of one year from date. State is directed to communicate this order to the learned Trial Court within a week from date. The application for bail, being CRM (M) 2181 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
