The petitioners are seeking regular bail in connection with Bagodar P.S. Case No.208 of 2025 for the alleged offences registered under Sections 61(2) and 80 of Bharatiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate 1st Class, Giridih. 3. Learned counsel appearing for the petitioners submits that the petitioners are ladies. He further submits that the petitioner No.1 is mother of five children and out of five children four children are daughter and one of the child, aged about 2 years, was getting breastfeeding from his mother and in absence of 2026:JHHC:1175 --2-- B.A. No. 11366 of 2025 their mother the children are living in distress. He then submits that petitioner No.1 is the sister-in-law and petitioner No.2 is the mother-in-law and there is no eye witness. He next submits that in the postmortem report it has come that cause of death is asphyxia due to drowning. He also submits that the petitioners are in custody since 15.08.2025. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there against the petitioners of torturing. 5. Considering that the petitioners are ladies and one of the petitioner is having the children of two years and in the postmortem report it has come that cause of death is asphyxia due to drowning and the petitioners are in custody since 15.08.2025, I am inclined to grant regular bail to the petitioners. 6. Accordingly, the petitioners, above named, shall be released on regular bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate 1st Class, Giridih in connection with Bagodar P.S.
