The petitioner participated in an e-tender floated by the South 24 Parganas Zilla Parishad for construction of 18 primary health centres under Pathar Pratima Block, South 24 Parganas and was entrusted the work by the Zilla Parishad. The petitioner completed the work successfully and was granted completion certificate for the same. Out of the entire bills raised by the petitioner, an amount of Rs.40,71,873/- is still due. The petitioner seeks disbursal of the same. Learned counsel for the Zilla Parishad accedes to the submission made on behalf of the petitioner and submits that the due has not been cleared due to non-availability of fund. The fund is to be provided by the Secretary, Health and Family Welfare Department, Government of West Bengal to the Additional District Magistrate and Executive Officer, South 24 Parganas Zilla Parishad for disbursal. In view of the above, the Joint Secretary, Department of Health and Family Welfare, Government of West Bengal being the 2nd respondent herein, is directed to disburse the amount of Rs.40,71,873/- to the Additional District Magistrate and Executive Officer, South 24 Parganas Zilla Parishad, being the 4th respondent herein, within eight weeks from the date of communication of this order. The 4th respondent is directed to disburse the said amount in favour of the petitioner within two weeks from the date of receipt thereof subject to the petitioner complying with all requisite formalities. With the above observation and direction, this writ petition is disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh,J) 2
