IN THE HIGH COURT AT CALCUTTA Constitutional Writ Jurisdiction (Appellate Side) W.P.A. NO 24263 OF 2026 Manoranjan Mondal -vs- The State of West Bengal & Ors. Ms. Tithli Piplai ….for the petitioner. Mr. Binoy Kumar Das ….for the respondent no.4.
1. Matter is heard in presence of learned advocates representing petitioner and respondent no.4.
2. By presenting this writ petition prayer is made for directing concerned police authorities to take steps which would preserve right of petitioner to cultivate agricultural land in question. It is further submitted on behalf of petitioner that in spite of lodging complaint on 22nd July, 2026, police authority is not taking steps.
3. Learned advocate representing respondent no.4 disputes submission made on behalf of petitioner and it is submitted that respondent no.4 is having right over the said agricultural land. It is also contended that respondent no.4 is having right to cultivate said land in question.
4. In view of rival submissions made on behalf of petitioner and respondent no.4, it appears that both the parties are claiming right over same agricultural
land in question requiring parties to approach appropriate authority/forum in pursuit of remedy.
5. Police authority is not the appropriate authority to decide inter se right of the parties over agricultural land in question.
6. However, concerned police authority is directed to maintain peace and tranquility at the locale and to see no untoward incident takes place.
7. Writ petition stands disposed of.
8. Since State respondents are not represented today, learned advocate for petitioner is directed to communicate this order to Officer-in-Charge, Kultali Police Station being respondent no.3 by seven days from date.
9. Parties to act on the server copy of this order duly downloaded from the official website of this Court. (Saugata Bhattacharyya, J.) 2
