The Court made the following: 3 THE HONOURABLE SRI JUSTICE D RAMESH THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI CIVIL MISCELLANEOUS APPEAL No.599 of 2025 JUDGMENT: (Per Hon’ble Sri Justice D.Ramesh) The present appeal is filed against the orders dated 30.12.2024 in H.M.O.P.No.159 of 2023 on the file of the Court of I Additional Senior Civil Judge at Kakinada. 2. The said H.M.O.P.No.159 of 2023 was filed by the appellant/wife under Section 13(1)(ia)(ib) of the Hindu Marriage Act, 1955 seeking divorce on the ground of cruelty and desertion. After considering the evidence of PWs.1 and 2, RWs.1 and 2 and based on the record, the Court below dismissed the said O.P. 3. While pending the appeal, the matter has been referred to the Mediation Centre and both the parties have appeared before it and compromised the matter. As per the report of the Mediation Centre dated 06.05.2026, the matter was settled with the following terms: “The disputes in M.C.No.4 of 2021 and D.V.C.No.559 of 2023 have already been settled before the Lok Adalat at Kakinada. The parties have also agreed to settle the 4 criminal case in C.C.No.1727 of 2021 before the Lok Adalat. The respondent has agreed to transfer Ac.0.50 cents of land situated at T.Kothapalli Village, I.Polavaram Mandal, Dr. B.R.Ambedkar Konaseema District bearing Survey No.395/2 in favour of the appellant. Both parties agreed to permanently live separately and have mutually consented for dissolution of marriage and seek appropriate orders from this Hon’ble Court.” 4. Based on the report of the Mediation Centre, this Court, by order dated 16.06.2026, directed both the parties to appear before this Court on 29.06.2026. Today, both the parties appeared before this Court and submitted that the appellant has already withdrawn M.C.No.4 of 2021 and D.V.C.No.559 of 2023. They further submitted that C.C.No.1727 of 2021 is still pending and they are ready to withdraw the same. The respondent also expressed willingness to transfer the land as agreed before the Mediation Centre. 5. Considering the submissions made by both the parties and considering their request and also on perusal of the report of the Mediation Centre, both the parties are relegated to the trial Court to file an appropriate petition under Section 13B of the Hindu 5 Marriage Act. If any such petition is filed, the trial Court may consider the same in terms of the compromise recorded before the Mediation Centre and dispose of the petition expeditiously if required, by giving exemption to Section 13B(2) of the Hindu Marriage Act, in accordance with law. 6. With the above observations, the Civil Miscellaneous Appeal is disposed of. There shall be no order as to costs.
