1. Affidavit-of-service filed in Court today is taken on record.
2. The petitioner was serving as an Assistant Head Teacher of a high school. He has impugned the decision of the Deputy Director of School Education (GA) dated 15th September, 2022 rejecting his prayer for grant of stagnation increment.
3. Learned Advocate for the petitioner submits that after filing the writ petition and after service of a copy of the writ petition upon the authority, the memorandum dated 23rd December, 2024 has been issued by the Deputy Secretary, School Education Department, Secondary Branch whereby the employees of the West Bengal Recognized Non-govt.

sponsored/aided institutions have been allowed annual increment for stagnation.
4. It has been submitted that after the petitioner retired from service on 30th June, 2024, the stagnation benefit has been disbursed in the P.P.O.
5. He prays for payment of the arrear stagnation benefit for the period 1st July, 2021 to 30th June, 2022 and 1st July, 2022 to 30th June, 2023.
6. It appears that the petitioner has already received the benefit of stagnation in his pension payment
order. Whether he would be entitled to receive the benefit for the aforesaid period has to be decided.
7. The District Inspector of Schools (S.E.), Nadia, is
directed to take necessary steps to consider and decide as to whether the petitioner would be entitled to the benefit in terms of the memorandum No. 1669-SED-11019/1/2022-SECND SEC-Dept. of SE dated 23rd December, 2024 issued by the Deputy Secretary, School Education Department, Secondary Branch.
8. If the claim of the petitioner is allowed then steps shall be taken to release the arrear due to the petitioner.
9. Steps shall be taken by the D.I. at the earliest but positively within a period of eight weeks from the date of communication of this order.

10. WPA 22705 of 2024 stands disposed of.
11. There shall be no order as to costs.
12. All parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
13. Certified server copy of this order, if applied for, be supplied to the parties on compliance of all requisite formalities.
