Kausik (Rejected) CRM (NDPS) 1992 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Chakdaha Police Station Case No. 112/24 dated 05.02.2024 under Sections 21(c) of the NDPS Act, 1985. And In the matter of : Avijit Das @ Ledu @ Gedu ……Petitioner. Mr. Sumanta Chakraborty Ms. Tanisha Parua ……for the Petitioner. Mr. Gouranga Kr. Das, Ld. APP Mr. Amal Kr. Datta Ms. Nabanita Chatterjee ……for the State. Learned advocate appearing for the petitioner submits that petitioner is in custody from 5th February, 2024 i.e. 2 years 7 months. According to the petitioner only 60 bottles of cough syrup were recovered. On the other hand, learned advocate for the State submits that out of 16 witnesses, 11 witnesses have already been examined. Having considered the period of detention of the present petitioner and the fact that commercial quantity of contraband has been seized from petitioner, as a matter of last chance, 2 State is directed to complete rest of the witnesses by 28th February, 2027. In case, for reasons otherwise the trial cannot be completed within the aforesaid period, learned Trial Court would release the petitioner on bail on such terms and conditions as it deems fit and proper for ensuring further appearance. Additionally, it is stated that the aforesaid release on bail would be subjected to the condition that during the next 5 months petitioner cooperates with the trial of the case and for systematic delay only the progress of the case cannot take place. No unnecessary adjournment be granted to any of the parties and the trial of the case would continue in spite of any resolution of the local bar. With the aforesaid observations bail at this stage is rejected. However, learned Trial Court would adhere to the directions passed above. With the aforesaid observations CRM (NDPS) 1992 of 2026 is disposed of. Memo of Evidence submitted be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. 3 Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
