Mr. Bilal Ahmed, learned counsel for the Applicant.
2. Mr. Pradeep Lohani, learned AGA with Mr. Chitrarth Kandpal, learned Brief Holder, for the State of Uttarakhand.

In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Rohit, who has been accused in Case Crime No.189 of 2025, under Sections 109, 190, 191 (1), 193 (3) of BNS, at Police Station GangNahar, District Haridwar.

In a nutshell, the case of the prosecution is that the complainant lodged an FIR dated 11-05-2025 at P.S GangNahar Roorkee District Haridwar with the allegation that on 10-05-2025 near about 6:00 P.M. his son was standing on the road while Rahim, present Applicant and other 10-12 persons came there and fired on his son, due to this, his son sustained injury and he was referred AIIMS, Rishikesh.

Learned counsel for the Applicant submits for the
consideration of the bail that the Applicant has falsely been implicated in the present matter and the Applicant was not involved in the commission of the present crime. He further submits that the Applicant has been languishing in jail since
12.05.2025.
6. Learned State Counsel has vehemently opposed the bail application of the Applicant with a submission that the Applicant has criminal history. He further submits that the bail
may not be granted to the Applicant as there is a possibility of threatening and coercing witnesses and absconding by the Applicant.
7. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail.
8. Accordingly, bail application is allowed. It is directed that the Applicant - Rohit, who has been accused in Case Crime No.189 of 2025, under Sections 109, 190, 191 (1), 193 (3) of BNS, at Police Station GangNahar, District Haridwar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him.
