GP MUNCIPAL ADMN AND URBAN DEV AP The Court made the following: 2 ORAL ORDER: Heard Sri Kambhampati Ramesh Babu, learned Counsel for the Writ Petitioner, Sri M. Srinu Babu, learned Assistant Government Pleader for Municipal Administration & Urban Development and Sri Gudapati Lakshminarayana, learned Standing Counsel for Gudur Municipality. 2. Sri Gudapati Lakshminarayana, learned Standing Counsel for Gudur Municipality, has submitted the Written Instructions furnished by the Commissioner, Gudur Municipality dated 07.04.2026. Copy of it is supplied to the learned Counsel for the Writ Petitioner and the same is taken on record. 3. The Written Instruction would indicate that out of the amount that is claimed by the Writ Petitioner, an amount of Rs.9,56,600/- has already been paid. Learned Counsel for the Writ Petitioner has admitted this aspect that Rs.9,56,600/- has already been paid by the Respondents and received by the Writ Petitioner. The Written Instruction would indicate that a balance net amount of Rs.17,85,205/- is due from the Respondents. 4. At this stage, learned Counsel for the Writ Petitioner would submit that this amount of Rs.17,85,205/- does not include the Earnest Money Deposit (EMD) & Further Security Deposit (FSD) amount which is required to be released by the Respondents. He would submit that the Respondents, in cany case, cannot retain the EMD & FSD when once they have admitted that the works have been duly completed by the Writ Petitioner. 5. In this view of the matter, there shall be a direction to the Respondent Nos.3 & 4 to return the EMD & FSD with respect to all the works within a period of one week from today. Insofar as the balance amount due to the Writ Petitioner in respect of works, this Court holds that the Petitioner is entitled for the said amount of Rs.17,85,205/-. 6. Under these circumstances, this Court deems it appropriate to allow this Writ Petition with a direction to the Respondent Authorities, particularly Respondent Nos.2 to 4, to complete the entire administrative process, both 3 inter-departmental and intra-departmental, by way of mutual cooperation and coordination, within a period of twelve (12) weeks from today and transfer the due amount to the bank account of the Writ Petitioner within four (4) weeks thereafter. 7. It is clarified that this is the amount which is due to be paid to the Writ Petitioner for the works executed by him and it is dehors the EMD & FSD, which shall be returned to the Writ Petitioner within one week from today, as indicated above. 8. Writ Petitioner is directed to submit the bank account details to the Competent Authority within one week from today for effective compliance. 9. With these observations and directions, this Writ Petition stands allowed. No order as to costs. 10.
