In the matter of: Dinesh Kumar Goyal …petitioner.
Ms. Sutapa Roy Chaudhury, Ms. Aratrika Roy.
…for the petitioner
Mr. Kallal Mondal, Mr. Aditya Tiwari, Ms. Namrata Chatterjee.
….for the State
1.
Learned counsel for the State files status report of the Bidhannagar (South) Police Station Case No. 210/2013 dated 03.12.2013 under Section 420/453/465/468/ 471/380/506 on behalf of the Inspector-in-Charge Bidhannagar (South) P.S., let the said report be taken on record.
2.
Learned counsel for the petitioner prays that the impugned criminal proceeding, in view of submission of the Final Report and acceptance of it by the learned Magistrate, since has been quashed, he prays that the present revisional application has become infructuous and may be dismissed as such.
3. It appears from the said report that the charges levelled against the petitioner (Mr. Dinesh Kumar Goyal) in the said proceeding could not be prima facie established due to ‘lack of evidence at hand’, as such the case was ended in final report for Want of Evidence vide No. 99/2019 dated 16.07.2019. It also appears
2 from the said status report that the said F.R.T. (Final Report) was accepted by the learned Additional Chief Judicial Magistrate, Bidhannagar on 6th April, 2024.
4. In view of the acceptance of the said Final report by the Ld. A.C.J.M., Biddhannagar, thus leading to quashing of the FIR and closure of the said criminal proceeding arising out of the Bidhannagar (South) Police Station Case No. 210/2013 dated 03.12.2013, I find that nothing remains to be decided in the present revisional application, as such, this Court accepts the prayer of the learned counsel for the petitioner.
5. Accordingly, C.R.R. 2697 of 2015 is dismissed as infructuous.
6. Pending applications, if there be any, are also dismissed accordingly.
7. Interim order, if any, stands vacated.
8. No order as to costs.
