This bail application has been filed on behalf of Shamim Ansari who is in custody since 28.10.2025 in connection with Barharwa P.S. Case No. 292 of 2025 for the offence registered under Sections 376 and 313 of the IPC and Section 6 of POCSO Act pending in the Court of learned Special Judge POCSO Act, Sahibganj, is pressed into motion. The matter involves sexual exploitation on a false promise of marriage. As per the case of the prosecutrix, in 2020 she came in contact with this petitioner who on a false promise of marriage established physical relationship as a result she became pregnant. She was administered tablet for termination of pregnancy resulting in abortion. The main grievance is that, despite the promise of marriage, this petitioner did not marry her. It is submitted by the learned counsel on behalf of petitioner that offence under Section 6 of the POCSO Act will not apply in the present case as the case has been lodged on 28.10.2025 when the victim was aged 20 years. Alleged incident took place four years back on 07.03.2021, but the case has been lodged on 28.06.2023 after a delay of four years . It is also submitted that there is no material to show that she complained about this to anyone. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
