Heard Mr. S C Biswas, the learned counsel the appearing for the petitioner. Also heard Mr. D P Goswami, the learned Additional Public Prosecutor appearing for the State of Assam.
2. This is an application under Section 442 read with Section 438 of the BNSS, 2023 in respect of NDPS Case No.86/2025 pending in the Court of the learned Special
Page No.# 2/2 Judge, Cachar, Silchar.
3. The Vehicle No.AS-02AR-1545 was seized in connection with the aforesaid case and the prayer for custody of the said vehicle was allowed on a condition that the petitioner has to provide a bank guarantee equal to the value of the vehicle.
4. Mr. Biswas submits that it would be difficult for the petitioner to get custody of the vehicle in such circumstances.
5. I have considered the submissions made by the learned counsel of both sides.
6. This Court is of the opinion that the condition imposed upon the petitioner for taking the vehicle in his custody is a stringent one and therefore, it needs to be modified.
7. It is hereby directed that the petitioner has to provide a bond of ₹2 lakh (Rupees two lakh) for getting the vehicle in his custody. With the aforesaid direction, the criminal petition stands disposed of accordingly. JUDGE Comparing Assistant
