The matter was taken up for hearing earlier. Even on that date, it was recorded that the victim girl has not been recovered yet. Yet, till date, neither the petitioner nor the principal accused took any steps to have the girl produced before the concerned Magistrate or the Police authorities. From the statement of a neighbour contained at page 71 of the case diary it appears that the petitioner was purportedly in touch with the principal accused who had kidnapped the minor girl. Considering the above and the other incriminating materials available in the case diary and the fact that the minor victim girl has 2 not been recovered yet, I do not consider this to be a fit case for granting anticipatory bail to the petitioner. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
