GP FOR CIVIL SUPPLIES The Court made the following order: Heard Sri M.M.M.Srinivasa Rao, learned counsel for the petitioner and Sri Vineeth Appasani, learned Assistant Government Pleader for Civil Supplies, for the respondents 1 to 4. 2. The petitioner was appointed as a permanent Fair Price Shop Dealer vide F.P. Shop No. 0820038, Thativaripalem Village, Martur Mandal, Bapatla District. The 3rd respondent issued a show cause notice vide Rc.No.265/2026- B dated 04.06.2026 (Ex.P2), pursuant to the report submitted by the 4th respondent vide Rc.No.143/2026/A dated 02.06.2026. 3. As seen from the show cause notice, Ex.P2, two charges were framed against the petitioner regarding variations. The petitioner submitted an explanation dated 12.06.2026 (Ex.P3). 4. Learned counsel for the petitioner would submit that the 3rd respondent has not proceeded further pursuant to the show cause notice. However, the petitioner is not being supplied with the essential commodities for distribution to the cardholders. Page 3 of 4 5. Learned Assistant Government Pleader for Civil Supplies, on instructions, would submit that, pursuant to the show cause notice, Ex.P2, and the explanation submitted by the petitioner, Ex.P3. No further action was initiated. A temporary order has been given to Sri Sandepamu Basavaiah, VRA, Bollapalli Village, for the smooth distribution of essential commodities and also to avoid inconvenience to the cardholders. 6. Thus, as seen from the material available on record, there is no dispute regarding the issuance of the show cause notice, Ex.P2, and the explanation, Ex.P3. The authorisation of the petitioner is subsisting as of today. In the absence of any order passed pursuant to the show cause notice, withholding the supply of essential commodities to the petitioner and preventing the petitioner from distributing the same to the cardholders is impermissible and contrary to Clause 8(4) of the A.P.S.T.P.D.S. (Control) Order, 2018. 7. Given the facts and circumstances of the case, keeping the writ petition pending and inviting a counter may not serve any purpose. Accordingly, the writ petition is disposed of, at the stage of admission, with the consent of both the learned counsel, directing the 3rd respondent to forthwith allow the petitioner to distribute the essential commodities to the cardholders in respect of the F.P. Shop No. 0820038, Thativaripalem Village, Martur Mandal, Bapatla District. However, this order will not preclude the authority from proceeding with the inquiry. There shall be no order as to costs.
