The applicant who is in custody since 31.01.2026 has approached this Court for grant of regular bail in connection with Manika P.S. Case No.91 of 2025, registered for the offence under Sections 316(2) and 318(1) of the B.N.S., 2023, pending in the court of learned A.C.J.M., Latehar. 2. It has been submitted by learned counsel for the applicant(s) that complete set of F.I.R. alongwith its enclosure have been annexed with this bail application and there is no suppression on his/her part. 3. Innocence has been claimed and undertaking has been given for participation in the trial. It has been submitted by the learned counsel for the applicant that at best it is a commercial transaction and if there is any violation of the oral or written agreement between the parties, the criminality cannot be attached. On above basis, prayer for bail has been made. 4. Learned Spl. P.P. and learned counsel for the informant have opposed the prayer for bail of the applicant and submitted that it is a case under Section 316 of B.N.S., 2023 as the applicant has been cheated. In spite of receiving the money, machinery in question has not been supplied. 5. Considering the fact that it is a commercial transaction between the parties, I am inclined to enlarge the applicant on bail. Accordingly, the applicant, named above, is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Latehar in connection with Manika P.S. Case No.91 of 2025, subject to the deposit of Rs.25,000/- to the Advocate's Clerk Association, Jharkhand High Court, Ranchi. Further the applicant will submit self-attested copy of his Aadhaar Card and also give his mobile number before the learned trial court which he will not change during pendency of this case without prior permission of the court.
