C HANUMANTHA RAO The Court made the following: 4 VS,J W.P.No.456 of 2018 ORDER: This Writ Petition came to be filed under Article 226 of the Constitution of India, seeking the following prayer: “…to issue an appropriate Writ, Order, or Direction, more particularly one in the nature of WRIT OF MANDAMUS directing the Respondent Nos.3 to 5 to provide certified copies of the Adangals in respect of Property bearing Sy.Nos. 57/3, 4 ,5 and Sy.No.58, Sy.No.59/1,2 and 3, Sy.No.66/1 to 4 and Sy.No.58/1 of Marripalem Village, Visakhapatnam Urban and Mandal, Visakhapatnam District and Sy.Nos.41/1 and 41/2 of Kapparada Village for the years 1959, 1960, 1961 to 1965 and pass…” 2. The petitioner submitted an application dated 03.02.2016 under Section 6 of the Right to Information Act, 2005, before the respondent No.5 seeking certified copies of old adangals pertaining to different survey numbers situated in Marripalem village, Visakhapatnam urban and mandal, Visakhapatnam district. Aggrieved by the inaction of the respondent authorities in supplying the said certified copies, the petitioner filed appeals before the State Information Commissioner vide S.No.9252 and 9269/CIC-MR/2016, wherein, an order was passed on 26.05.2016 directing the 5th respondent herein to furnish copies of the documents sought by the petitioner. In spite of the same, as the 5th respondent is not supplying the documents sought by the petitioner, the present writ petition is filed. 5 VS,J W.P.No.456 of 2018 3. When the writ petition came up for hearing on 30.01.2018, this Court passed an interim order directing the 5th respondent to comply with the order dated 26.05.2016, passed by the Chief Information Commissioner, A.P. Information Commission, Hyderabad, within a period of four weeks. 4. The 5th respondent has filed a counter affidavit enclosed with a vacate stay petition, wherein, it is stated that as per the interim orders granted by this Court on 30.01.2018, the 5th respondent has supplied the adangal copies of Fasli No.1369(1959), 1370(1960), 1371(1961) and 1385 (1975) of Marripalem village. In respect of Kapparada village, adangal for fasli No.1405 (1995) was supplied along with settlement record i.e., MDR (Manuscript Diglot Register) copy for the survey numbers which are available, vide Rc.No.422/2018/A, dated 22.02.2018, through registered post (RN897635567IN) on 24.02.2018. 5. Heard Sri. Gangisetti Uma Sankar, learned counsel for the petitioner and learned Assistant Government Pleader for Revenue. 6. Perused the material available on record. It can be seen that pursuant to the interim order passed by this Court on 30.01.2018, the 5th respondent has furnished the available adangals to the petitioner as sought by him as per the provisions of the Right to Information Act. In view 6 VS,J W.P.No.456 of 2018 of the same, this Court is of the opinion that the cause in the writ petition would not survive for further adjudication. 7. Accordingly, this writ petition is dismissed. There shall be no order as to costs.
