2. Mr. Pradeep Lohani, learned AGA with Mr. Chitrarth Kandpal, learned Brief Holder, for the State of Uttarakhand.

In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Mohd Rehan, who has been accused in FIR No.188 of 2025, dated 20.11.2025, under Sections 109, 3 (5) of BNS, 2023 and under Sections 3/25 of the Arms Act, 1959, at Police Station Pantnagar, District Udham Singh Nagar.
4. In a nutshell, the case of the prosecution as per the FIR is that, on 20.11.2025, at about 02:58 hours there is an allegation of firing on Police by the present Applicant and others, and therefore, the FIR was registered under the aforesaid offences.

Learned counsel for the Applicant submits for the
consideration of the bail that Applicant has falsely been implicated in the present crime and the Applicant is languishing in jail since 20.11.2025.
6. On the other hand, bail application has been opposed by the learned State Counsel on the ground that the Applicant has hardened criminal history and prays that the Applicant
may not be enlarged on bail.
7. To this, learned counsel for the Applicant submits that there is another case of robbery shown against present Applicant, bail has been granted by the learned court of District and Sessions Judge, Udham Singh Nagar, Rudrapur, vide order dated 31.01.2026.
8. Considering the overall facts and circumstances of the case, the Applicant has made out a case for bail.
9. Accordingly, bail application is allowed. It is directed that the Applicant - Mohd Rehan, who has been accused in FIR No.188 of 2025, dated 20.11.2025, under Sections 109, 3 (5) of BNS, 2023 and under Sections 3/25 of the Arms Act, 1959, at Police Station Pantnagar, District Udham Singh Nagar, be released on bail on furnishing a personal bond with two reliable sureties each in the like amount to the satisfaction of the concerned court. The Applicant shall cooperate with the trial proceedings and shall not misuse the liberty granted to him.
