Sharwari …for the petitioners. Mr. Madhu Jana Ms. Puja Sonkar …for the State. The private respondents are not represented. No report has been filed on behalf of the State despite being called for. Learned counsel for the petitioners submits that the private respondents in collusion with the Gram Panchayat have unlawfully constructed a public toilet in the premises in respect of which the petitioner is a co-sharer. A representation was submitted before the concerned authority in this regard which not being considered, the petitioners approached this Court in WPA 12607 of 2023. By an order passed on 13th November, 2024, a co-ordinate Bench of this Court directed the Block Development Officer to consider and dispose of the representation within a stipulated time frame. The order was not complied with for which a contempt application was filed. The contempt application was disposed of directing disposal of the representation. 2 Learned counsel submits that the representation is still pending. In view of the fact that the representation is pending since 5th April, 2023, the Block Development Officer, Kultali, being the 7th respondent herein, is directed to consider and dispose of the same within four weeks from the date of communication of this order upon granting reasonable opportunity of hearing to all concerned including the petitioners and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. In the event the said authority arrives at a decision in favour of the petitioners, necessary consequential steps be taken at the earliest. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
