The petitioner named above has been made accused in connection with T. Tanger P.S. Case No. 41 of 2022 (S.T. No. 147 of 2022) for the offence registered under Sections 302 of the Indian Penal Code, pending in the court of learned Sessions Judge, Simdega. The informant is the eye witness herself and the petitioner is her nephew. As per the FIR, her husband was assaulted indiscriminately by the petitioner with respect to the land dispute resulting in his death during course of treatment on the very next day of the incident. It is submitted by learned counsel for the petitioner that since the incident took place on spur of moment, therefore, offence under Section 302 of IPC will not be made out. The petitioner is in custody since 29.06.2022. Learned counsel for the State has opposed the prayer for bail and submitted that out of nine charge-sheeted witnesses, five have been examined and the case is now posted for evidence of doctor and investigating officer. Considering the fact that the petitioner is named in the FIR and there is direct and specific allegation against him of causing death by assaulting the deceased indiscriminately, I am not inclined to enlarge the petitioner on bail.
