THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE DR. JUSTICE K.MANMADHA RAO ORAL ORDER Learned counsel for the petitioners and learned counsel for the respondent are present. 2. Learned counsel for the respondent filed memo for disposal of this petition along with the copy of the order sheet in Crl.Misc.No.281/2022 and mediation agreement dated 02.09.2023 stating that the parties have agreed to the following terms and conditions of settlement and the same reads as thus: - 3 - HC-KAR NC: 2026:KHC:14174 WP No. 9156 of 2023 <1. On account of temperamental attitudes and difference of opinion they have been living separately. Both the parties state that the respondent had filed a petition for divorce in M.C. No.3724/2013 which after contest came to be allowed by judgment dated 24.01.2022. The 1st petitioner herein has filed MFA No. 2810/2022 against the said judgment and the Hon'ble High Court of Karnataka has passed an order of stay on 28.03.2022. The 1st petitioner has also filed W.P. No. 9156/2023 seeking certain directions. 2. The parties having decided to put an end to litigation have decided to settle the matter, in that the respondent has agreed to pay a sum of Rs.30,00,000/- (Rupees Thirty Lakhs Only) as maintenance / permanent alimony to the petitioners herein in the following manner: a. Rs.20,00,000/- for the 1st petitioner as permanent alimony. b. Rs.10,00,000/- for the minor daughter Harshika for her education and maintenance. 3. The respondent agrees to pay the sum of Rs.20,00,000/- by way of Demand Draft drawn in favour of the 1st petitioner before the Hon'ble Court on or before 04.11.2023. The respondent also - 4 - HC-KAR NC: 2026:KHC:14174 WP No. 9156 of 2023 agrees and undertakes to pay the sum of Rs.10,00,000/- by depositing the said sum in the name of the 2nd petitioner in State Bank of India, Vyalikaval Branch, Bengaluru or any other bank account in fixed deposit for a period of 9 years i.e., till she attains the age of 21 years, on or before 04.11.2023. The 1st petitioner agrees to share the bank account Code / details for the aforesaid purpose. 4. The petitioners state that apart from the above amount of Rs.30,00,000/-, they do not have any claim against the respondent for maintenance, either past, present or future. 5. In view of the settlement the 1st petitioner agrees to withdraw MFA No. 2810/2022 pending before the Hon'ble High Court of Karnataka, Bengaluru, thereby confirm the judgment passed in M.C. No. 3724/2013. Similarly, the 1st petitioner also agrees to withdraw W.P. No. 9156/2023 pending before the Hon'ble High Court of Karnataka, Bengaluru subject to realization of amount. 6. Both the parties agree that they will produce a copy of this memorandum of settlement before the Hon'ble High Court of Karnataka, Bengaluru in MFA No. 2810/2022 and W.P. No. 9156/2023 with a - 5 - HC-KAR NC: 2026:KHC:14174 WP No. 9156 of 2023 request to pass appropriate orders in terms of this settlement. They also request the Bangalore Mediation Centre to forward a copy of the settlement to the Hon'ble High Court of Karnataka, Bengaluru. 7. The 2nd petitioner/Kumari Harshika.C is entitled for the family health insurance scheme benefits provided to the respondent as and when required by 2nd petitioner to claim medical expenses as per the insurance policy. 8. Both parties hereby agree that they will not interfere in the peaceful living of each other in future.= 3. In view of the aforesaid agreement entered into between the parties, the dispute stands resolved. Accordingly, this writ petition is disposed of.
