The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of regular bail, as he has been arrested in connection with Crime No. 214/2025, registered at Police Station Mahasamund, District – Mahasamund (CG) for the offence punishable under Sections 317(2), 317(4), 318(4), 61(2) and 3(5) of BNS. 2. The prosecution story in brief, is that the Indian Cyber Crime Coordination Center received several complaints made by different persons in the year 2023 all over India regarding serval mule accounts and their fraudulent transfers in which report was forwarded to the concerned police headquarters Chhattisgarh. During the investigation of several mule account holders were apprehended by the police and further during the online statement from the banks was received by the RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 prosecution agency the account of the present applicants was also involved in which the applicant received sum of rupees 13 lakh. Hence aforesaid offences were registered against the applicant. Hence, this application. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. It is further submitted that the charge-sheet has been filed in the present case. It is further submitted that all of the seizure witnesses have been examined before the trial Court, given their statements and have turned hostile. The applicant is in jail since 26.05.2025 and the trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application and submits that the charge-sheet has been filed in the present case before the competent Court. It is further submitted that the bail applications of the co-accused persons have already been rejected by this Court vide orders dated 25.09.2025, 25.09.2025 and 12.11.2025 in MCRC Nos. 5389/2025, 5365/2025 and 8034/2025, therefore, the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy and the fact that all of the seizure witnesses have been examined before the trial Court, given their statements and have turned hostile, which goes to show that the applicant who is confined in jail has tampered with the evidence, 3 furthermore, the bail applications of the co-accused persons have already been rejected by this Court vide orders dated 25.09.2025, 25.09.2025 and 12.11.2025 in MCRC Nos. 5389/2025, 5365/2025 and 8034/2025, charge-sheet has been filed in the present case, therefore, this Court is of the opinion that is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant- Preetam Alias Prem Markandey, involved in Crime No. 214/2025, registered at Police Station Mahasamund, District – Mahasamund (CG) for the offence punishable under Sections 317(2), 317(4), 318(4), 61(2) and 3(5) of BNS, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and concluded the trial expeditiously. 9.
