JUSTICE E.S.INDIRESH - 3 - HC-KAR CNR: KAHC010659362026 NC: 2026:KHC:52047 WP No. 29987 of 2026 ORAL ORDER In this writ petition, the petitioners are assailing the order dated 25.06.2026 (Annexure-A) passed by the respondent No.2 and the eviction notice dated 16.05.2026 (Annexure-A1). 2. Having heard the learned counsel appearing for the parties, I am of the view that the respondent authorities are stating that, the petitioners herein have encroached the public land. 3. In that view of the matter, it is open for the respondent No.2 along with the jurisdictional ADLR to conduct the spot inspection and survey in respect of the land in question and in the event, if the respondents authorities find that the public road has been encroached by the petitioners or any other person, then it is open for the respondent-authorities to take decision in the matter in accordance with law. - 4 - HC-KAR CNR: KAHC010659362026 NC: 2026:KHC:52047 WP No. 29987 of 2026 4. In that view of the matter, respondent No. 2 is directed to conduct spot inspection and survey of the land in question along with the jurisdictional ADLR in the presence of the petitioners on 27.10.2026 at 11.00 a.m. and thereafter take decision in the matter in accordance with law. 5. Till the consideration of the same, respondents-authorities are hereby directed not to take any precipitative action against the petitioners. 6. Accordingly, the petition stands disposed of.
