3. The present application has been filed by the Appellant/State seeking special leave to appeal against the
judgment and order dated 28.08.2025 passed by the court of learned Special Judge (NDPS Act), District Udham Singh Nagar in Special Session Trial No.9 of 2015, “State Vs. Malkeet Singh” under Sections 8/18 of the Narcotic Drugs and Psychotropic Substances Act, 1985, whereby the accused/Respondent – Malkeet Singh, had been acquitted by the learned Trial Court.
4. After hearing the learned counsel for the Appellant, the present matter needs deliberation, this Court is satisfied that the Appellant has made out a prima facie case warranting
consideration. Special leave to appeal is granted.
5. The application is treated as an appeal and is admitted.
6. Heard on the delay condonation application.
7. The delay is of 42 days’ in filing the present government appeal.
8. This Court finds ground for condonation of the delay is sufficient. For the reasons indicated in the delay condonation application, the same is allowed, and the delay in filing government appeal is hereby condoned.
9. The matter needs consideration. Let the Trial Court Record be summoned. After receipt of the same, let the paper- book be prepared and supplied to the learned counsel for the parties on the payment of usual charges.
10. List this matter on 09.06.2026.
