No.24/2023 pending before the Sessions Judge, Hassan arising from Crime No.38/2022 for the offences under Section 498A, 323, 342, 307, 504, 506 114 read with Section 34 of Indian Penal Code, 1860 ('IPC') and Sections 3 and 4 of Dowry Prohibition Act, 1961. 3. The petitioners and the second respondent are present. Learned counsel for the petitioners and second respondent are present. It is submitted that the dispute between the parties are amicable settled. 4. The second respondent is the wife of petitioner/accused No.1. Petitioners No.2, 3 and 4 are the family members of the petitioner No.1. It is also submitted that, the divorce petition filed by the petitioner No.1 and the second respondent invoking Section 13B of the Hindu Marriage Act, 1955 is amicably settled and the marriage is dissolved. 5. Considering the application and also the charge sheet materials, the Court is of the view that, there is no justification directing the prosecution as the complainant has secured the decree for dissolution of marriage on amicable terms. The application is also signed by the parties to the proceedings. 7. Considering the materials on record, the application is allowed. Hence, the following: ORDER (i) Petition is allowed. (ii) Proceedings in S.C. No.24/2023 pending before the Sessions Judge, Hassan (arising from Crime No.38/2022) is quashed.
