Learned Additional Government Advocate accepts notice for the respondent Nos.1 to 3. 2. In this writ petition, the petitioner is assailing the order dated 25.02.2025 (Annexure-F) passed by respondent No.2 and the Order dated 23.06.2026 (Annexure-G) passed by respondent No.1. 3. Heard Sri.B.R.Vishwanath, learned counsel appearing for the petitioner and Sri.Aditya Diwakara, learned - 3 - HC-KAR CNR: KAHC010621122026 NC: 2026:KHC:51632 WP No. 28433 of 2026 Additional Government Advocate appearing for respondent Nos.1 to 3. 4. Sri.B.R.Viswanath, learned counsel appearing for the petitioner by referring to MR.H18/2015-2016 submitted that the petitioner is claiming right over the property to an extent of 40 guntas in Survey No.28 of Bellundagere Village of Mandya Taluk and District and as such, the property belonging to the petitioner is quite different from the property mentioned in the registered sale deed dated 16.01.2024, claimed by the private respondent herein. Accordingly, sought for allowing the petition. 5. Learned Additional Government Advocate sought to justify the impugned orders. 6. In the light of the submissions made by learned counsel for the parties and on careful consideration of the same, would indicate that the mutation entry has been made based on the registered sale deed dated - 4 - HC-KAR CNR: KAHC010621122026 NC: 2026:KHC:51632 WP No. 28433 of 2026 16.01.2024. Therefore, I am of the view that no interference is called for in this petition. 7. However, perusal of the finding recorded by the Deputy Commissioner, Mandya District, would indicate that the erstwhile Survey No.28 has been changed as Survey No.202 after durasth. 8. In that view of the matter, I am of the view that if there is any discrepancy as to the boundaries of the properties is concerned, it is open for the petitioner to establish the same before the competent Civil Court in the manner known to law. Accordingly, there is no perversity in the orders passed by the respondents - authorities. 9. In that view of the matter, reserving liberty to the petitioner to establish right over the property in the manner known to law, the writ petition is disposed of.
