p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.2979 of 2026 Gobinda Chandra Sahoo …. Petitioner(s) Mr. Byomakesh Tripathy, Advocate -versus- State of Odisha …. Opposite Party(s) Mr. Jateswar Naik, AGA CORAM: JUSTICE SIBO SANKAR MISHRA Order No. ORDER 23.04.2026 01. 1. Heard. 2. This ABLAPL has been filed apprehending arrest consequential to an FIR likely to be instituted in Charichaka P.S., District-Puri and Parjang P.S., District-Dhenkanal. 3. Learned counsel for the petitioner, on instruction from the petitioner, submits that, except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R. 4. The prosecution case, in brief, is that the petitioner had entered into an arranged marriage, and initially, the family shared a cordial relationship with p. 2 the bride, treating her with love and affection. However, over time, the petitioner allegedly came to know that she was having an affair with his nephew, namely Durgaprasad Sahoo. It is further alleged that she subsequently eloped with the said Durgaprasad Sahoo from her matrimonial home and has been residing separately for the last two months at Old Town, Bhubaneswar. It is also alleged that the situation escalated when she threatened to initiate false legal proceedings against her husband and his family members if they attempted to persuade her to return to her matrimonial home. 5. Learned counsel for the petitioner submits that although no F.I.R. has yet been registered, but the petitioner apprehends arrest and approached this Court. 6. Learned counsel for the State on the other hand submits that since no F.I.R. has been registered and the dispute appears to be arising out of the matrimonial discord, the bail application for anticipatory bail is premature. p. 3 7. Be that as it may, in the event an F.I.R. is registered and the petitioner is arrayed as an accused, before taking any coercive action, the police shall issue a written notice to the petitioner before one month. 8. With this observation, the ABLAPL is disposed of. (S.S. Mishra) Judge Swarna
