JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by accused No.12 under Section 483 of BNSS praying to grant bail in Crime No.41/2022 of Panambur Police Station registered for offences punishable under Sections 302, 212, 120(B) r/w. Section 149 of IPC pending in SC No.154/2023 on the file of VI Additional District and Sessions Judge, D.K., Mangaluru. 2. Heard the learned counsel for the petitioner and the learned Additional State Public Prosecutor for the respondent-State. 3. The petitioner earlier has been granted bail by order dated 07.11.2022 and he has been released on bail. On 07.12.2024 the jurisdictional Court cancelled his bail on the ground that he has violated the bail condition. Thereafter, he remained absconding due to which a case against him came to be split up and registered in - 3 - HC-KAR NC: 2026:KHC:20182 CRL.P No. 15811 of 2025 S.C.No.34/2025 and Non-Bailable-Warrant came to be issued against the petitioner. He has been secured on 19.05.2025 by executing Non-Bailable-Warrant against him and the petitioner is in judicial custody since then. The petitioner has deposited Rs.1,00,000/- towards forfeited bond on 24.03.2026 in S.C.No.154/2023 pending on the file of Principal District and Sessions Judge, Mangaluru. It is submitted that the petitioner could not appear before the trial Court as he lost communication with his counsel. 4. Considering the above case, the following; ORDER i) The petition is allowed. ii) The petitioner is granted bail in SC No.154/2023 pending on the file of VII Additional District and Sessions Judge, D.K.,Mangaluru, subject to following conditions; - 4 - HC-KAR NC: 2026:KHC:20182 CRL.P No. 15811 of 2025 a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the trial Court. b) The petitioner shall not tamper the prosecution witness either directly or indirectly. c) The petitioner shall attend the trial Court on all dates of hearing unless exempted and co- operate for speedy disposal of the case.
