This Criminal Appeal (SJ) has been filed under Section 14A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 with the prayer to quash and set aside the order dated 17.03.2025 passed by the learned Special Judge, SC/ST Act, Godda in Misc. Cr. Appl. No.244 of 2025 by which the prayer for regular bail of the appellant was rejected in connection with Deodanr P.S. Case No.08 of 2025. 3. The allegation against the appellant is that the appellant has ravished the victim by committing rape upon her. The prosecutrix has been examined as PW-4 during the trial and has supported the case of the prosecution and all other witnesses have also supported the case of ( 2026:JHHC:7998 ) 2 Cr. Appeal (SJ) No.570 of 2025 the prosecution. The learned Special Judge, SC/ST Act, Godda considering the serious nature of allegation against the appellant as well as the evidence in the record that has become during t, he trial rejected the prayer for bail. 4. Learned senior counsel for the appellant submits that the appellant has been implicated in a false case due to village politics of committing rape upon an old lady of 67 years. It is next submitted that the false implication is because of dispute regarding irrigation of land between the parties. It is next submitted that the victim sustained minor injuries after falling down on her own and that the appellant neither assaulted her nor committed rape upon her, hence, it is lastly submitted that the prayer as prayed for by the appellant in this appeal, be allowed. 5. Learned Addl. P. P. appearing for the State on the other hand vehemently opposes the prayer of the appellants and submits that keeping in view the serious nature of allegation against the appellant of committing rape upon the prosecutrix; which has been supported by the prosecutrix in her deposition as PW-4 during the trial of the case and all other witnesses examined so far in the trial, have also supported the case of the prosecution, there is every chance of the appellant absconding and tampering with evidence if released on bail, so the learned Special Judge, SC/ST Act, Godda has rightly rejected the prayer for regular bail. Hence, it is submitted that this Criminal Appeal (SJ), being without any merit, be dismissed. ( 2026:JHHC:7998 ) 3 Cr. Appeal (SJ) No.570 of 2025 6. Having heard the rival submissions made at the Bar and after carefully going through the materials available in the record, this Court finds that there is direct and specific allegation against the appellant of committing rape upon the prosecutrix which has not only supported by the prosecutrix herself in her deposition as PW-4, but has also been supported by the other witnesses of the case; who have been examined during the trial of the case and in view of such allegation of serious nature against the appellant, this Court do not find any illegality in the order dated 17.03.2025 passed by the learned Special Judge, SC/ST Act, Godda rejecting the prayer for regular bail of the appellant warranting interference of this Court in exercise of its appellate jurisdiction. 7.
