1. The petitioner prays for higher scale of pay. His prayer appears to have been taken up for
consideration and an urgent hearing in the chamber of the District Inspector of Schools, (SE), North 24 Parganas was taken on July 9, 2019. The fate of the hearing has not been made known to the petitioner till date.
2. It appears that considerable period of time has elapsed from the date of the hearing. The concerned officer who conducted the hearing may not be holding the post at present.

In view of the above, the instant writ petition stands disposed of by directing the present DI of Schools (SE), North 24 Parganas to consider the petitioner’s prayer for grant of higher scale of pay strictly in accordance with law and in line with the law laid down by the Hon’ble Division Bench of this Court in the matter of Utpal Kanti Karan v. State of West Bengal & Ors. reported in (2024) SCC OnLine Cal 1274.
4. A decision shall be taken in the mater at the earliest but positively within a period of twelve weeks from the date of communication of this
order.
5. If the prayer of the petitioner is allowed, then necessary consequential steps shall be taken for disbursing the higher scale of pay.
6. An opportunity of hearing be provided to the petitioner for production of all necessary documents in support of his prayer.

Learned counsel for the petitioner shall forward a copy of the subject representation along with all supporting documents to the aforesaid respondent at the time of communicating this
order.
8. All parties are to act on the server copy of this
order duly downloaded from the official website of this Court.
