JUSTICE ANANT RAMANATH HEGDE ORAL ORDER Heard the learned counsel appearing for the petitioner and the learned High Court Government Pleader for respondent No.1-State. 2. This petition is filed to quash the proceedings in C.C. No.599/2026 for the offence punishable under Sections 352, 115(2), 118(1), 74, 351(2) of Bharatiya Nyaya Sanhita, 2023 ('BNS') pending before the JMFC, Kanakapura. 3. Learned counsel for the petitioner would submit that the petitioner visited the police station two days after the incident to lodge a complaint against the complainant and family members. However, the police have not registered the complaint. The complainant is politically strong and because of the influence of the complainant, the petitioner’s wife's complaint is not yet investigated, though the petitioner is the victim. 4. Learned counsel for the petitioner would submit that the petitioner has not committed any offence and a false charge sheet is filed against the petitioner. 5. Learned HCGP would submit that there is an allegation of bleeding injury near the eye as well as assault on the forehead. The complainant has gone to the hospital and taken treatment and medical certificate is produced. It is also the contention that there are eye witnesses to the alleged incident as such, the matter requires trial. 6. On a pointed question put forth by the Court as to why the report is not filed on the complaint filed by the petitioner's wife, learned HCGP would submit that appropriate report would be filed after investigation. 7. The Court has considered the contentions raised at the Bar and perused the records. According to the materials on record, it appears that the case is a counter case filed relating to the same incident. 9. That being the position, the Court is of the view that the matter requires trial. Hence, the petition is dismissed. 10. The respondent-State is also directed to file appropriate report on the complaint filed by the petitioner's wife registered in Crime No.161/2025 before the Sathanoor P.S., Bengaluru. 11. It is made clear that observations made in this order are not on the merits of the defence to be raised by the petitioners. 12. All contentions are kept open.
