2. Mr. Pradeep Lohani, learned AGA with Mr. Chitrarth Kandpal, learned Brief Holder, for the State of Uttarakhand.

In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Aakash, who has been accused in Case Crime No.674 of 2021, under Sections 363, 366, 376 (2) (dha), 376 (3) of IPC, and under Sections 5 (J) (ii) and 5/6 of the POCSO Act, at Police Station Laksar, District Haridwar.
4. As per the case of the prosecution, an FIR was lodged by the complainant/father of the victim under Section 363 of IPC with regard to the missing of his daughter against the Applicant - Aakash.

Learned counsel for the Applicant for the consideration of the bail submits that the Applicant has falsely been implicated in the present matter and the Applicant has not committed any crime. He further submits that there is no physical relationship of the Applicant with the victim/prosecutrix.
6. On the other hand, the bail application of the Applicant has been vehemently opposed by the learned State Counsel on the ground that the victim is a minor girl and the date of birth of the victim is 08.07.2006 and the victim is the niece
(Bhanji) of the present Applicant.

Considering the overall facts and circumstances of the case and the fact that the victim is a minor girl, the Applicant has not made a case for bail in connection with the Case Crime No.674 of 2021, under Sections 363, 366, 376 (2) (dha), 376 (3) of IPC, and under Sections 5 (J) (ii) and 5/6 of the POCSO Act, at Police Station Laksar, District Haridwar. Consequently, the bail application of the Applicant is hereby rejected.
