Accused in Crime No.321/2026 registered by Yelahanka New Town Police Station, Bengaluru, for the offences punishable under Sections 77, 78, 75(2), 351, 352 and 109 of BNS, 2023 and Section 66(E) of the Information Technology Act, 2000, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.321/2026 was registered by Yelahanka New Town Police Station, Bengaluru, for the aforesaid offences, against petitioner herein based on the first information dated 23.07.2026 received from the alleged victim girl, aged about 20 years. During the course of investigation of the said case, petitioner was arrested on 24.07.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.7761/2026 was rejected on 12.08.2026. Perusal of the material on record would go to show that victim girl aged 20 years and the petitioner are acquainted to each other for the last more than one year. A reading of the first information would reveal that subsequently, they had developed relationship and in the month of November, 2025, victim girl allegedly had gone to see the petitioner and they got intimate with each other. Without the knowledge of the victim girl, the petitioner allegedly recorded their video and thereafter, he started emotionally blackmailing the victim girl and also was abusing and assaulting her. It is further alleged that on 06.07.2026, petitioner, who came near the house of the victim girl had allegedly asked her to sit in his car and thereafter, assaulted her with a cutter and also slapped her face. Subsequently, petitioner was stalking the victim girl and was torturing her. Efforts made by the victim girl to put an end to their relationship had failed and therefore, she had approached the police. 5. Undisputedly, in respect of the alleged incident that had taken place on 06.07.2026 in which the petitioner had assaulted the victim girl with a cutter, no complaint was lodged - 4 - HC-KAR CNR: KAHC010623262026 NC: 2026:KHC:54165 CRL.P No. 13870 of 2026 by the victim girl. A reading of the first information would reveal that victim girl has not suffered any injury as a result of the alleged assault made by the petitioner. Undisputedly, petitioner and the victim girl were in a relationship for more than one year. Considering the aforesaid aspects of the matter, the following order:- 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.321/2026 registered by Yelahanka New Town Police Station, Bengaluru, for the offences punishable under Sections 77, 78, 75(2), 351, 352 and 109 of BNS, 2023 and Section 66(E) of the Information Technology Act, 2000, subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; - 5 - HC-KAR CNR: KAHC010623262026 NC: 2026:KHC:54165 CRL.P No. 13870 of 2026 c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
