Learned advocate appearing for the petitioner submits that the petitioner is in custody for one month three days and the incident complained of is on 24.06.2026 and refers to the date of offence as 23.05.2021/24.05.2021. State was specifically confronted on the issue relating to whether any arms have been recovered. Having considered the date on which the offence occurred and the complaint in respect of which the case has been registered and there being no seizures in respect of the Arms Act, I am of the opinion that further detention of the present petitioner in connection with the instant case is unwarranted. As such, the prayer for bail of the petitioner is allowed. 2 Accordingly, the petitioner viz., Sanat Dey shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Barrackpore. If on bail, the petitioner shall make himself available before the Investigating Officer of the case as and when called for. In case petitioner leaves the State of West Bengal, he shall inform the learned Additional Chief Judicial Magistrate, Barrackpore before leaving the State. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (R) 102 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
