CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 19.01.2026
01.
1. Heard learned counsel for the petitioners and State.
2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Aska P.S. Case No749 of 2025 corresponding to G.R. Case No.2261 of 2025 pending in the court of learned J.M.F.C., Aska on the grounds stated.
3. From the FIR at Annexure-1, the Court finds that the petitioner alleged to have assaulted wife of the informant by means of a ‘lathi’ causing injury to her hand. It is submitted to the Court by Mr. Sahoo, learned counsel for the petitioners that the victim was treated and thereafter discharged and as such, the injury, if any, received by her is not grievous. Learned counsel the State would submit that the victim was referred to MKCG Medical College and Hospital, Berhampur for further treatment. Recording such submissions as above and the reason behind the dispute between both the sides resulting in the p. 2 assault of the victim, who the wife of the informant and the fact that the injury received by the latter is not serious, this Court though not inclined to grant them pre-arrest bail, however, is of the view that they should be directed to surrender before the learned court below for being released on bail with suitable conditions.
4. Accordingly, it is ordered.
5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is directed that in the event, the petitioners surrender before learned J.M.F.C., Aska in connection with Aska P.S. Case No749 of 2025 corresponding to G.R. Case No.2261 of 2025 within fifteen days, they shall be released on bail with such other conditions subject to verification of the medical examination report of the informant’s wife and absence of any grievous injury received by her.
6. Issue urgent certified copy of this order as per rules.
