ORAL ORDER The captioned petition is filed by the son assailing the order passed by the respondent No.2/Tribunal declaring the gift deeds dated 16.01.2023 as void. 2. A joint compromise petition is filed today by the petitioner and respondent No.3/mother. Since respondent No.3, though present before this Court, is not represented by an Advocate, this Court has independently interacted with her. On specific queries put by this Court, respondent No.3 has stated that she has perused and understood the contents of the joint compromise petition.
She further submits that she is a B.E. graduate, has previously worked in BESCOM, and that her decision to enter into the present compromise is voluntary, made out of her own free will, without any force, coercion, or undue influence. She has also stated that, in terms of the compromise, she proposes to execute and register a fresh gift deed in favour of the petitioner and her grandson, allotting 50% share each. - 4 -

3. The son, who is present before this Court, submits and undertakes that he shall take due care of his mother and ensure that all her basic needs and amenities are provided for. He further undertakes that such care and support will be extended voluntarily, without any neglect, and in a manner befitting his obligation towards his mother. This undertaking is placed on record. 4. In view of the statement made by respondent No.3, who is present before this Court, and upon being satisfied that she is well-educated, fully aware of the legal implications of the compromise, and that the compromise petition has been executed on her own volition and upon her instructions, this Court deems it appropriate to accept and take the joint compromise petition on record. 5. In light of the amicable settlement arrived at between the petitioner and respondent No.3/mother, the impugned order passed by respondent No.3 is hereby set aside. The petition stands disposed of in terms of the joint
