Side) PRAYER :- Criminal Miscellaneous Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita Act, 2023, to modify the condition 6(b) imposed on the petitioners in Crl.O.P.(MD).No.6748 of 2026, dated 22.04.2026 and consequently direct the petitioners to appear before the respondent police “as and when required” instead of the daily appearance condition. ORDER : The Court made the following order :- 1/4 https://www.mhc.tn.gov.in/judis CRL MP(MD).No.12516 of 2026 This petition has been filed by the petitioners to modify the condition 6(b) imposed on the petitioners in Crl.O.P.(MD).No.6748 of 2026, dated 22.04.2026 and consequently direct the petitioners to appear before the respondent police “as and when required” instead of the daily appearance condition. 2.By the order dated 22.04.2026 in Crl.O.P.(MD).No.6748 of 2026, this Court imposed condition, which reads as follows: “6(b) the petitioners shall report before the respondent police, daily at 10.00 a.m., until further orders.” 3.The learned Government Advocate (Crl. Side) would submit that both the petitioners have not comply the above said condition even for a single day. 4.The learned counsel for the petitioner submitted that the second petitioner is 78 years old and having so many ailments. Hence, she is not able to comply the condition. 5.In view of the above said submissions, this Court is of the view that the reason stated for the second petitioner is acceptable one. Hence, the above said condition is modified in respect of the second petitioner to that effect that “the second petitioner shall appear before the respondent police as and when required for interrogation”. 6.In respect of the first petitioner is concerned it is stated that since he is in London, he is unable to comply the above said condition. This court is not inclined to modify the condition in respect of the first petitioner. Hence, this petition stands dismissed in respect of the first petitioner.
