Kausik (Allowed) CRM (A) 3028 of 2026 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Jagatballavpur Police Station Case No. 112 of 2026 dated 18.04.2026 under Section 85/80(2)/3(5) of the BNS, 2023 read with Section 3/4 of the Dowry Prohibition Act, 1961. And In the matter of : Jayanta Dolui ……Petitioner. Mr. Sabir Ahmed Mr. Dhiman Banerjee ……for the Petitioner. Mr. Indradip Das Mr. Arijit Banik ….for the State. Learned advocate appearing for the petitioner submits that petitioner is the brother-in-law who has been foisted with a criminal case and implicated in a case of dowry death. It has been submitted that charge sheet has already been filed before the jurisdictional Court and the husband who is the principal accused was arrested and subsequently granted bail. Learned advocate for the State opposes the prayer for bail. Having considered the materials appearing against the petitioner and the fact that charge sheet has been submitted, I 2 am of the view that custodial detention of the present petitioner at this stage is unwarranted. As such, prayer for anticipatory bail is allowed. As such, I direct that in the event of arrest, the petitioner, namely, Jayanta Dolui be released on bail subject to the satisfaction of the investigating officer/arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As charge sheet has already been submitted this order of anticipatory bail will be valid for a period of 6 weeks. Accordingly, CRM (A) 3028 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
