1. Heard Mr. S. Nawaz, learned counsel for the petitioner. Also heard Mr. K. Baishya, learned Additional Public Prosecutor for the State of Assam.
2. This is an application filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in respect of Special NDPS Case No.222/2025, pending in the
Page No.# 2/2 Court of the learned Special Judge, Nagaon.
3. The petitioner, Wasikul Islam has been shown as an absconder in the Charge-Sheet for recovery of 7.54 gms of narcotic drugs. He submits that he is interested in facing the trial and, therefore, he should be given adequate opportunity to that effect.
4. I have considered the submissions made by the learned counsel for both sides.
5. Since, the petitioner is interested in facing the trial, he should be given adequate opportunity to that effect. Therefore, the prayer of the petitioner is allowed.
6. The petitioner, Wasikul Islam is directed to appear before the Trial Court in respect of Special NDPS Case No.222/2025 on 23.04.2026 and on his appearance, the petitioner shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Special Judge, Nagaon.
7. The petitioner is directed appear regularly in the Trial Court on each and every date of hearing. If he fails to do so, without showing sufficient reasons, the Trial Court shall have the liberty to procure his attendance by due process of law.
8. With the aforesaid direction, this Criminal Petition stands disposed of. JUDGE Comparing Assistant
