The petitioners are apprehending their arrest in connection with Pakur Town (Malpahari O.P.) P.S. Case No.320 of 2025 for the alleged offences registered under Sections 303(2) and 317(2) of Bharatiya Nyaya Sanhita, 2023, Section 4/21 of Mines and Minerals (Development & Regulation) Act, 1957, Rule 54 of Jharkhand Minor Mineral Concession Rules, 2004 and Rule 7/9/13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2017 pending in the Court of learned S.D.J.M., Pakur. 3. Learned counsel appearing for the petitioners submits that petitioner No.1 is the owner and petitioner No.2 is the driver of 2026:JHHC:8391 --2-- A.B.A. No. 1112 of 2026 Hywa Truck and the allegations are made of carrying stone chips in the said hywa. She further submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.12 of the petition. She then submits that the owner and driver of another truck have been granted anticipatory bail in A.B.A. No.629 of 2026. 4. Learned counsel appearing for the State opposed the prayer and submits that illegally stone chips were being carried in the said hywa. 5. Considering that the petitioner No.1 is owner and petitioner No.2 is driver of the said hywa and in identical situation co-accused persons have already been granted anticipatory bail in the aforesaid ABA and the petitioners have got no criminal antecedent as disclosed in paragraph No.12 of the petition and in that view of the matter the petitioners are directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioners on such terms and conditions or the sureties as the learned Court may deem fit and proper.
