IA No. 4296 of 2026 has been filed by the petitioner stating therein that the present case arises from a case under Section 229B of the U.P.Z.A. & L.R. Act. During the pendency of the writ petition, the petitioner and the respondents arrived at a compromise and settled their dispute on 15.12.2026. It is stated in the application that during the pendency of the aforesaid writ petition, the petitioner and the respondents entered into a compromise and a settlement agreement was prepared between the parties on 15- 12-2025. As per the aforesaid settlement agreement, the respondents handed over the possession of the land of Khasra no. 414, measuring 0.566 hectare, Khasra no. 415 measuring 0.001 hectare, Khasra no. 416 measuring 0.030 hectare, total 0.597 hectare, situated in village Kharmasi, Tehsil- Kashipur, District- Udham Singh Nagar to the petitioners after receipt of agreed settle amount through demand draft. That thereafter the respondents filed an withdrawal application before the Assistant Collector Ist Class Kashipur on 15-12- 2025, which was allowed by the Assistant Collector Ist Class Kashipur vide order dated 16- 12-2025 and suit was dismissed as withdrawn. 4. Since the plaintiff has already withdrawn the suit on account of the compromise arrived at between the parties, nothing survives in the matter. The writ petition is disposed of in terms of the settlement arrived at between the parties. 5. The writ petition stands disposed of accordingly. (Siddhartha Sah, J.) 28.04.2026 BS
