According to the petitioner, he was engaged on contract as Junior Engineer in Public Works Department in the year 2014, and he served in that capacity for more than 10 years. His engagement was, however, discontinued without any rhyme and reason. In this writ petition, petitioner has sought the following reliefs: “I) Issue a writ, order or direction, in the nature of mandamus commanding the respondents to allow the petitioner to work at the post of Junior Engineer (Civil). II. Issue a writ, order or direction, in the nature of mandamus commanding the respondents to give appointment to the petitioner in terms of the order dated 11.06.2025 passed by the Division bench of this Hon’ble Court in SPA No. 24/2025 being “Ajay Panwar & others Vs. State of Uttarakhand & others.” 3. Learned counsel for the petitioner refers to a judgment rendered by Division Bench of this Court in Special Appeal No. 24 of 2025. He also relies upon an interim order passed by this Court in Writ Petition (SS) No. 991 of 2026. 4. Learned State Counsel submits that petitioner has not mentioned the date when he 2026:UHC:3257 was disengaged from Public Works Department. He submits that without making averment regarding date of his discontinuance, he cannot get benefit of interim order, as was passed in that writ petition filed by other contractual Junior Engineer. 5. This Court finds substance in the submission made by learned State Counsel. It is not known whether the petitioner was disengaged from P.W.D. in 2020 or 2023. 6. Having regard to the facts and circumstances of the case, and also in view of prayer made by learned counsel for the petitioner, writ petition is disposed of by permitting petitioner to make representation for his re-engagement to the competent authority. 7. If he makes representation within two weeks from today, decision thereupon shall be taken by the competent authority, as per law, within 10 weeks thereafter.
