The petitioner in the instant case applies for the grant of a license against the declared vacancy of the FPS (Ration Shop) for the area near Char Jalpai Office Pally, Saudhali, Nandigram-I Block under Vacancy ID 202200248413 SCFS-Haldia, through Memo No. 218/SCH/F/VACANCY /24 dated 15.5.2024. 2. It is submitted that an inspection has been conducted and the petitioner has been found to be an eligible candidate. However, till date, the decision has not been uploaded on the portal. 3. The petitioner has made a detailed representation against the non-issuance of license despite being first empanelled for appointment as an FPS dealer dated 8.1.2026 however, the representation remains pending for consideration. 4. Learned counsel appearing for the State respondent submits that the instant writ petition is premature in nature as the selection process has not yet been completed. 5. Learned counsel for the State respondent draws the attention of this Court to the penultimate paragraph of the representation. The extract from the representation is reproduced below: “ Thereafter I have gathered information from my reliable sources that the I was placed at Serial no. 1, thereby establishing that I was the most eligible candidate among all applicants.” 6. Having heard the parties and upon perusing the records made available, I am of the considered view that respondent no. 3 shall consider the representation dated 8.1.2026 with the assistance of the Enquiry Officer to ascertain whether the petitioner has already been selected and declared to be a suitable candidate for appointment as an FPS Dealer. 7. The respondent no. 2 shall give an opportunity of hearing to the petitioner along with other stake holders, if any, and pass a reasoned order in accordance with law and communicate such decision within a week thereafter. 8. However, it is made clear that if the process has already been completed, the decision shall forthwith be uploaded on the portal so as to 2 complete the entire selection exercise as expeditiously as possible. 9. The writ petition being WPA 2913 of 2026 is disposed of without going into the merits of the case. 10. Urgent photostat certified copy of this order, if applied for, be given to the learned counsel for the parties on usual undertakings (Smita Das De, J.) 3
