IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.2985 of 2026 Ganesh Patra …. Petitioner(s) Mr. Asit Kumar Jena, Advocate -versus- State of Odisha …. Opposite Party(s) Ms. Suvalaxmi Devi, ASC CORAM: JUSTICE SIBO SANKAR MISHRA Order No. ORDER 23.04.2026 01. 1. Heard. 2. The petitioner is seeking pre-arrest bail in connection with Jatni P.S. Case No.31 of 2025 corresponding to G.R. Case No.45 of 2025 registered on the allegation of the commission of offences under Sections 333/296/115(2)/74/303(2)/351(2)/3(2) of B.N.S., 2023 read with Section 3 and 4 of the E.S. Act and Section 25 of the Arms Act pending in the Court of the learned J.M.F.C., Jatni. 3. Learned counsel for the petitioner, on instruction from the petitioner, submits that, except the present bail application, no other bail application of the petitioner is pending in any other Court relating to the aforesaid F.I.R. 4. The prosecution case in short is that on 19.01.2025 at about 9:05 A.M., the complainant appeared before the Police Station and submitted a written report alleging therein that on 18.01.2025 at around 7:00 P.M., while she and her two daughters-in- law were present in the house, the present petitioner, namely Ganesh Patra, along with one Dillip Badajena, suddenly entered into the house and, in abusive language, enquired about the whereabouts of one Debasish. It is alleged that when the complainant and her daughters-in-law sought to know the reason, both the accused persons abused and assaulted them. The petitioner is further alleged to have stated that Debasish had taken a sum of Rs. 20,000/- from him. During the course of the incident, the petitioner allegedly assaulted the elder daughter-in-law. Upon the arrival of neighbours, both the accused persons attempted to flee from the spot and, while doing so, allegedly snatched a gold chain from the neck of the complainant. It is further alleged that while fleeing, they left behind a Bullet motorcycle. Subsequently, at about 12:20 A.M. and again at about 1:30 A.M. during the night, both the accused persons allegedly returned carrying two bombs and hurled the same at the complainant’s tractor, and also extended threats to the family members by means of deadly weapons. It is further alleged that on 19.01.2025 at about 8:00 A.M., the accused persons again threatened the family members of the complainant. Hence, the present case has been registered. 5. Learned counsel for the petitioner submits that the alleged dispute arose because of Rs.20,000/- which was taken as a loan by one Debassish Das, who is related to the petitioner. 6. Learned counsel for the State, on the other hand, has produced the injury report, which indicates that no external injuries were found on the person of the victim and the injuries are simple in nature. 7. Regard being had to the submission made by the learned counsel for the petitioner and the nature of allegation, I am inclined to grant the petitioner on anticipatory bail. Accordingly, it is directed that in the event the petitioner is arrested, he shall be released by the Arresting Officer, The release of the petitioner shall be subject to the conditions that he shall cooperate with the investigation and shall appear before the I.O. as and when his presence is required for the purpose of investigation; he shall not indulge in similar criminal offences while on bail. Violation of any of the conditions shall entail cancellation of bail. 8. With this observation, the ABLAPL is disposed of. (S.S. Mishra) Judge Swarna
