ORAL ORDER
1. In this writ petition, the petitioners-Decree Holders (plaintiffs) have sought for the following relief/s: <a) Directing the Prl. Senior Civil Judge and JMFC at Chitradurga to early disposal of the Ex.No.222/2023 is Produced as ANNEXURE-E, to the writ petition.

b) Issue any other order or direction as this Hon9ble Court may deem fit under the facts and circumstances of the case including as to the cost in the interest of justice and equity.=
2. The learned counsel for the petitioners submits that the petitioners3Decree Holders (plaintiffs) had filed a suit for specific performance of contract. After service of summons, the defendants3Judgment Debtors (respondents herein) appeared in the suit and the parties have settled the matter by way of compromise. However, the respondents have not executed the sale deed in terms of the compromise decree. It is further submitted that the petitioners3Decree Holders have filed an execution petition in Ex.No.222/2023 before the I Additional Senior Civil Judge and JMFC, Chitradurga (hereinafter referred to as 8Executing Court9 for short). As on this date, the said execution petition has not been disposed of. Learned counsel further contends that the Judgment Debtors are dragging the matter for one or the other reason. Hence, he prays for early disposal of the said execution petition.

3. In view of the above, without expressing any opinion on the merits of the case, the Executing Court is directed to dispose of Ex.No.222/2023, as expeditiously as possible, and in any event not later than six months from the date of receipt of a certified copy of this order, provided there is no order of stay of the said proceedings by any other Court.
