Learned advocate for the Petitioner has tendered service affidavits to support his contention that the contesting Respondents/ English Bazar Municipality, Malda has been served with advocate’s notice and is intimated of this proceeding.

2. The Petitioner has prayed in prayer Clause – ‘b’ that the Municipality be directed to initiate steps on the basis of the representation made by the petitioner to ensure that the Drain at Gazi Azam Municipal Market, Jaljalia, Malda, is cleaned up so that it does not spread infection and diseases on account of being blocked. The said representation dated 15.01.2026, addressed to the Chairman of the Municipality, be considered and acted upon.
3. An innocuous prayer is is put forth by the Petitioner. We are, therefore, not issuing Court notice to the Municipality in the backdrop of the Petitioner having served the Municipality, which has chosen not to appear in this proceeding.
4. We direct that the representation of the Petitioner dated 15.01.2026, shall be considered by the Municipality and after due verification and inspection of the premises with regard to which the Petitioner has lodged a complaint, ensure that the Municipality drain is cleaned of garbage and is allowed to flow free, as per the plans of the Municipality. Let such action be initiated and the drain be cleaned up within a period of 30 days from the date of service of the
order.
5. In view of the above, this Petition is disposed off.

6. The Petitioner would take a print out of this order from the official website of the Calcutta High Court and serve the same on the Municipality, by Speed Post acknowledgment due.
